In the event that Customer refuses to accept delivery of the purchased item(s) or fails to make payment when due, it will constitute a breach of this Agreement. CGG, in its sole discretion, shall be entitled to recover from Customer a 5 % (five percent) repurchase fee and the difference in any market fluctuations. CGG shall be entitled to recover any incidental damages caused by Customer's breach.
